PROMOTION DESCRIPTION: The 4‑H Changemaker Challenge Contest (the “Promotion”) consists of a photo with essay skill contest (the “Contest”). The Promotion will take place from April 27, 2018 through May 25, 2018. The intent of the Contest is to invite participants to upload a photo along with responses to three questions. Participation details will be as follows: “Tell us about a community project you work on with a group that involves technology. Maybe you lead an afterschool coding program or use 3D printers at your library to replace missing pieces in your schools’ chemistry sets. If you’re using technology as part of a community project, we want to hear your story! Youth can participate in a group by submitting a photo and answering three questions about their community projects.” Each Contest entry must clearly reflect the judging criteria, as defined below. The Contest will include a round of judging to determine ten (10) finalist (“Contest Finalists”) and a round of public voting to determine three (3) Contest Finalists as Runner Up Prize winners and one (1) Contest Finalist as the Grand Prize winner, as further described herein.

By entering the Promotion, each eligible participant (“Entrant”) unconditionally accepts and agrees to comply with and abide by these Official Rules and the decisions of National 4‑H Council (the “Sponsor”) and US Sweepstakes & Fulfillment Co. (the “Administrator”), which shall be final and binding in all respects.

ELIGIBILITY: The Promotion is open to legal residents of the 50 United States, including the District of Columbia, who are age 14 to 19 at the time of entry and are a current, registered 4‑H Member prior to Friday, April 27, 2018 and at the time of entry. To participate, an Entrant must be a member of a 4‑H group (a “Group”) where he/she works with the group on a community project that involves technology to make an impact in an innovative way. Void in Puerto Rico, Guam, the U.S. Virgin Islands, outside the U.S., and wherever else prohibited by law. Employees of the Sponsor, Administrator and their respective subsidiaries, affiliates, advertising and promotion agencies, and the immediate family members (spouses, parents, children, and siblings and their spouses) of, and/or those living in the same household of each, are not eligible to enter. Sweepstakes is subject to all applicable federal, state and local laws and regulations.

TIMING: The Promotion begins at 12:00:01 AM Eastern Time (“ET”) on Friday, April 27, 2018 and ends at 11:59:59 PM ET on Friday, May 25, 2018 (the “Promotion Period”) and consists of three (3) periods: The Contest Entry Period, Judging & Finalist Determination/Confirmation Period, and Public Voting Period as defined in the chart below. Contest Winners will be announced on/or about Monday, June 11, 2018. The Administrator’s computer is the official timekeeping device for this Promotion.

PRIZES/APPROXIMATE RETAIL VALUE (“ARV”):

  • Grand Prize: One (1) Grand Prize winning Entrant  (the “Grand Prize Winner”) will receive a travel package for the Entrant and up to three (3) members of his/her Group (each, a “Group Member”) and one (1) adult Group Leader (the “Group Leader”) to attend Citizenship Washington Focus (“CWF”) taking place in Washington, D.C. July 8 – 14, 2018 (each, a “Grand Prize Package”). The Grand Prize Package includes:
    • Round-trip, coach-class air-transportation for the Grand Prize Winner, Group Member(s), and one (1) parent/legal guardian of the Grand Prize winner to Washington, D.C. from a major airport within the U.S.A. near the winner’s residence as determined by Sponsor;
    • Seven (7) days / Six (6) nights hotel accommodations based on single room/double occupancy as determined by Sponsor;
    • 14 meals at National 4‑H Conference Center per person;
    • CWF workshop and activity materials;
    • Local transportation for CWF tours (visit to the Hill);
    • Round-trip transfers to/from destination airport and hotel;
    • One (1) Surface Pro 3 for Grand Prize Winner and each Group Member; and
    • $2,000 stipend to further the project featured in the Contest Entry.
    • Maximum total ARV of Grand Prize: $11,596
  • Second Prize: One (1) Second Prize winning Entrant will receive a $1,000 stipend to further the project featured in the Contest Entry. ARV of Second Prize: $1,000.
  • Third Prize: One (1) Third Prize winning Entrant will receive a $500 stipend to further the project featured in the Contest Entry. ARV of Second Prize: $500.
  • Maximum ARV of all prizes available to be won: $11,500.

THE CONTEST ENTRY PERIOD AND HOW TO ENTER THE CONTEST: The Contest Entry Period begins at 12:00:01 AM ET on Friday, April 27, 2018 and ends at 11:59:59 PM ET on Friday, May 18, 2018. During the Contest Entry Period, submit a photo responding to “Tell us about a community project you work on with a group that involves technology to make an impact in an innovative way” (a “Photo”) along with answering the three (3) questions as they pertain to your project (the “Essays”).

To enter, visit https://4-h.org/TechChangemakers (the “Promotion Website”), follow the instructions to provide your name and contact information group name, upload/access your Photo, follow all instructions to complete the contest entry form including your Essays and submit (the “Contest Entry”).

All Contest Entries must be received during the Contest Entry Period. There is a limit of one (1) Contest Entry per group. Each Contest Entry must include an original Photo and Essays. Contest Entries submitted with a Photo or Essay that has already been submitted will be disqualified.

Sponsor is not responsible for lost, late, incomplete, illegible, garbled, inaccurate, invalid, misdirected, undelivered, or delayed Entries. No altered or incomplete submissions will be accepted.

Entrants are subject to all notices posted online, including but not limited to the Sponsor’s Privacy Policy, available for review at https://4-h.org/privacy-policy/. Contest Entries may be posted to a public gallery within the Promotion Website (the “Contest Gallery”). The Sponsor will review all submitted Contest Entries prior to such Contest Entries being published and reserves the right in its sole and absolute discretion to reject, disqualify and/or remove any Contest Entry that violates these Official Rules without any notification or warning. Posting to the Contest Gallery does not indicate the Contest Entry has complied with the Official Rules. Sponsor reserves the right to post sample Photos it has created in connection with the Promotion on https://4-h.org/TechChangeMakers and https://4‑H.org . Sponsor does not guarantee the posting of any Contest Entry.

ENTRY REQUIREMENTS & CONDITIONS: All Contest Entries must comply with the following minimum guidelines to be eligible:

  • Entrants must be between fourteen (14) and nineteen (19) years of age.
  • Photo and description
  • Entrant and description should be the primary subject of the Photo and Essays. No other individuals may appear in the Photo, without express permission. If Photo features a minor under the age of majority in his/her state of residence, you must obtain written permission from the minor’s legal guardian.
  • Photos must conform to the format and size requirements and limitations of the Promotion Website or Instagram.
  • Contest Entry cannot contain content that is irrelevant to the purpose of the Contest.
  • Once a Contest Entry has been submitted, it cannot be modified or deleted by Entrant.
  • Each submitted Contest Entry must be original, on which no image editing software has been used.
  • No duplicate or substantially similar Photos or Essays, as determined by the Sponsor in their sole discretion, may be submitted.
  • By submitting a Photo taken by a third party, Entrant warrants and represents that he/she has secured all rights and clearances to the Photo from the photographer.
  • Contest Entry cannot be profane, pornographic, sexually explicit or suggestive or contain nudity.
  • Contest Entry cannot be violent or promote firearms/weapons.
  • Contest Entry cannot promote alcohol, illegal drugs or tobacco.
  • Contest Entry cannot defame, misrepresent or contain disparaging remarks about people, brands, products or companies.
  • Contest Entry cannot contain content that defaces or depicts any person, brand, product or company in a negative or inappropriate manner.
  • Contest Entry cannot be obscene or offensive, endorse any form of hate or hate group or be derogatory to any ethnic, racial, gender, religious, professional or age group.
  • Contest Entry cannot reference or contain materials embodying copyrighted images, names, likenesses or other indicia identifying any brand, products, company or person, living or dead, without permission.
  • Contest Entry cannot communicate messages or images inconsistent with the positive images and/or goodwill to which Sponsor wishes to associate.
  • Contest Entry cannot depict illegal activity and cannot itself be in violation of any law.
  • Contest Entry cannot in any way reference persons or organizations without written permission from any person or organization whose name or likeness is used.
  • Contest Entry may not include images of a known celebrity, famous or well-known person or any image which violates the right of privacy or publicity of any person.
  • Contest Entry cannot have been submitted previously in a promotion of any kind or won any previous awards.

By submitting a Contest Entry, the Entrant understands and grants to the Sponsor an irrevocable, perpetual, non-exclusive worldwide license to use his/her Entry, Photo, Essays, name, hometown and likeness on the Sponsor’s various websites and social media sites and in advertising and/or promotional activities worldwide without compensation, permission or notification. Each Sponsor reserves the right in its sole and absolute discretion to alter, change or modify any Contest Entry, which includes a Photo or Essay.

By submitting an Contest Entry, Entrant warrants and represents that: (a) Contest Entry, Photo and Essays do not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other legal or moral rights of any person or entity; (b) Entrant has obtained written permission from any person who may appear in the Photo; (c) Entrant owns all rights to the Photo, including without limitation, copyrights, and has received prior written permission from a third party if any Photo was photographed by someone other than the Entrant him/herself; and (d) Entrant will indemnify and hold harmless the Sponsor, Administrator and related entities, agents and assigns from any claims and damages (including reasonable attorneys’ fees) arising from or relating to the breach or alleged breach of Entrant’s representations and warranties herein, the Contest Entry, or Entrant’s conduct in creating the Contest Entry, the acceptance or use of any prize or otherwise in connection with this Promotion.

CONTEST ENTRIES POSTED TO THE PROMOTION WEBSITE ARE THE VIEWS/OPINIONS OF THE INDIVIDUAL ENTRANT AND DO NOT REFLECT THE VIEWS OF SPONSOR IN ANY MANNER.

JUDGING & FINALIST DETERMINATION: The Judging & Finalist Determination Period will begin on Saturday, May 19, 2018 and be completed on Tuesday, May 22, 2018. All eligible Entries received during the Contest Entry Period will be judged by the Sponsor, who shall use the criteria set forth below:

  1. Response to writing prompt via the Essays:
    1. Question 1:
      1. How well does Entrant articulate the problem the Group is trying to solve? (10points) (Criterion A)
      2. Does the project demonstrate creativity or “out of the box” thinking in the project design? (5 points) (Criterion B)
      3. Does the submission reflect an understanding of a specific community issue the Group is addressing? (5 points) (Criterion C)
    2. Question 2:
      1. How well does the Entrant demonstrate an understanding of how technology furthered their project? (10 points) (Criterion D)
    3. Question 3:
      1. Quality of the reflection (5 points) (Criterion E)
      2. How impactful is the project or what is the perceived potential for impact? (5 points) (Criterion F)
  2. Overall Quality of Entry, including the photograph and clarity of writing (10 points) (Criterion G)

The ten (10) Groups whose Contest Entries receive the highest total score based on the judging criteria will each be deemed a potential Contest Finalist. In the unlikely event of a tie, the tied Contest Entry with the highest score in Criterion A, How well does Entrant articulate the problem the Group is trying to solve, will be deemed the potential Contest Finalist. If additional tie breakers are needed, the tie-breaking mechanism above will be used; however, instead of the highest score in Criterion A determining the potential Contest Finalist from among the tied Contest Entries, the highest score in each of Criteria B through G, in sequence (to the extent needed) will determine the potential Contest Finalists. In the event additional tiebreakers are needed, all tied Contest Entries will be judged by a separate panel of judges using the judging criteria above.

FINALIST NOTIFICATION: Finalists will be notified via email and/or phone on or about May 22, 2018 regarding his/her status as a Finalist.

PUBLIC VOTING PERIOD: Starting at 12:00:01 AM ET on Wednesday, May 23, 2018 and ending at 11:59:59 PM ET on Friday, May 25, 2018, the ten (10) Contest Finalists will be posted on the Promotion Website for public voting (the “Finalist Gallery”).

To submit a vote, legal residents of the 50 United States or D.C. who are at least 14 years of age at the time of submitting a Vote, as defined below (“Voter”), may visit https://4-h.org/TechChangeMakers and, upon deciding which Finalist’s Contest Entry the Voter believes best expresses how the Group’s community project that involves technology makes an impact in an innovative way, Voter may click the “Vote” button associated with that Finalist’s Contest Entry and must follow all instructions to submit his/her vote (the “Vote”). A Contest Finalist may submit a Vote for his/her own Entry. Voters are subject to all notices posted online including but not limited to the Sponsor’s Privacy Policy.

There is a limit of one (1) Vote per person per day during the Public Voting Period. All Votes must be received between 12:00:01 AM ET on Wednesday, May 23, 2018 and 11:59:59 PM ET on Friday, May 25, 2018.

Votes become sole property of Sponsor and none will be acknowledged or returned. Nothing in these Official Rules shall obligate Sponsor to publish or otherwise disclose any Vote submitted in connection with this Promotion

Any attempt by a Finalist or any other person to gain Votes by promising a benefit to the Voter or any other person, including the use of sites such as Vote Exchange or other similar social media sites, may subject the Finalist and Voter to disqualification in the sole discretion of the Sponsor. Voters and/or Finalists who spam or create multiple or false accounts, use multiple IP addresses, multiple accounts, or use any other unauthorized method for the purpose of casting Votes (or otherwise undertake any act intended to manipulate or undermine the integrity of the Promotion) may have their Finalist Entry or Votes disqualified, as applicable. Decisions of the Sponsor is final relating to all aspects of the voting process and results. The Sponsor may disqualify any Finalist, Contest Entry, Vote, Voter, or related parties who violate or is suspected of violating any of the terms and conditions of the Promotion or these Official Rules.

WINNER DETERMINATION, NOTIFICATION & PRIZE ACCEPTANCE REQUIREMENTS: The results of the Public Voting Period will be combined with the Judging Score to determine the Final Score (each, a “Final Score”) for each Contest Finalist. The Public Voting outcome will be weighted as one-third of the Final Score and the Judging Score will be weighted as two-thirds of the Final Score. The Contest Finalist who receives the highest Final Score will be deemed the potential Grand Prize Winner.  The Contest Finalist who receives the second-highest Final Score will be deemed the potential Second Prize winner. The Contest Finalist who receives the third-highest Final Score will be deemed the potential Third Prize winner.

The potential winners will be notified on or about June 8, 2018 by the Administrator via email and/or phone and will be required to sign and return an Affidavit of Eligibility & Publicity/Liability Release and a W-9 Form (the “Releases”) within three (3) business days of notification. These Releases may require the winner to furnish his/her Social Security Number for the sole purpose of tax reporting, as required by law.

If the Second or Third Prize Winner is otherwise eligible under these Official Rules but is nevertheless deemed a minor in his or her state of primary residence, the prize will be awarded in the name of winner’s parent or legal guardian who will be required to execute and return the Releases on minor’s behalf.

If the Grand Prize Winner is otherwise eligible under these Official Rules, but is nevertheless deemed a minor in his or her state of primary residence, the Grand Prize will be awarded in the name of winner’s parent or legal guardian who will be required to execute and return the Releases on minor’s behalf and such parent or legal guardian (the “Winner’s Parent/Guardian”) must accompany Grand Prize Winner on the Grand Prize trip as the Group Leader or designate an adult who will serve as the 4‑H representative of the Group during the duration of CWF as the Group Leader, subject to the approval of the Sponsor. Grand Prize Winner must designate Group Members and Group Leader at the time of returning the Releases. All Group Members to participate in the Grand Prize trip will also be required to sign a Travel Companion Liability & Publicity Release, as detailed in the Grand Prize Conditions section below, which will include the Grand Prize Winner’s choice, or Winner’s Parent/Guardian’s choice, if applicable, of the Group Leader.

Grand, Second and Third Prize winners must provide details and planned use of stipends to further the project featured in his/her Contest Entry as required by Sponsor and to its satisfaction prior to the award of the stipend. Failure to provide the required and/or adequate information by the deadline provided by Sponsor’s at the time of request may result if forfeit of the stipend component of the Grand Prize and/or Second or Third Prize, as applicable.

Noncompliance will result in disqualification and the Contest Finalist who received the next highest Final Score will be deemed the potential prize winner and will be notified. Prizes will be awarded within approximately 30 days after verification.

 

PRIZE CONDITIONS: If any notification or prize is returned as undeliverable, or if potential Finalist or Grand Prize Winner is found to be ineligible or not in compliance with these Official Rules he/she will be disqualified.

Prizes are not redeemable for cash. Prizes are not assignable nor transferable. No substitution is permitted except if prize is unavailable, in which case a prize of equal or greater value will be awarded. No cash will be given in lieu of prizes and there will be no exchange or substitution of prizes, except at the sole discretion of the Sponsor. Any other incidental expenses on prize not specified herein are the winner’s sole responsibility.

Winners are responsible for all federal, state, local and income taxes associated with winning prize. Grand Prize Winners will be required to furnish his/her Social Security Number for the sole purpose of preparation of tax forms as required by law.

Except where prohibited by law, entry and acceptance of prize constitute permission to use Finalists/Winner’s name, prize won, hometown, likeness, video tape, photographs, and statements for purposes of advertising, promotion and publicity (including online posting) in any and all media now or hereafter known throughout the world in perpetuity, without additional compensation, notification or permission.

By accepting a prize, winner further agrees to release the Promotion Entities from any and all liability, loss or damage of any kind arising out of or in connection with your participation in this Promotion or with respect to the awarding, receipt, possession, use and/or misuse of any prize.

GRAND PRIZE CONDITIONS: Travel related expenses, including but not limited to, taxes, gratuities, incidentals, upgrades, insurance, service charges, airport surcharges, departure taxes, luggage fees, food & beverage and personal expenses such as telephone/Internet charges, and gift shop purchases are the sole responsibility of prize winner. Winner and travel companion must travel on same itinerary. Winner and travel companion must have valid photo ID and any other required documentation prior to departure. Prize must be used on dates specified or prize will be forfeited. Dates are subject to change. Travel is subject to availability. Trip must be booked approximately 1-week in advance and is only available from July 8, 2018 through July 14, 2018. Registrations for CWF must be completed www.4hcwf.org through National 4‑H Council Staff by July 2, 2018.

Sponsor will, in its sole discretion, determine which airport is closest to the Grand Prize Winner’s home. In the event the Grand Prize Winner’s residence is close enough to Washington, D.C. such that air transportation is deemed by Sponsor in its sole discretion to be unnecessary, the Sponsor reserves the right to substitute round-trip ground transportation to/from the Grand Prize Winner’s home in lieu of air transportation. The Grand Prize Winner and his/her travel companions are responsible for obtaining any travel insurance (and all other forms of insurance) that they may wish to obtain (at their own expense) and hereby acknowledge that the Sponsor has not and will not obtain or provide travel insurance or any other form of insurance.

Photo identification and credit card or cash deposit may be required at any time for incidental charges (e.g., room service, use of telephone/IT services, laundry and all other optional extra services not provided in the Grand Prize). If Grand Prize Winner elects to travel or partake in the Grand Prize with fewer than two (2) travel companions, no additional compensation will be awarded. All hotel reservations are based on availability and all holidays are excluded. Accommodations are subject to availability at time of reservation. Blackout dates, advance booking requirements and travel restrictions may apply. Availability is subject to factors such as weather, seasonality and space availability. Reservations are subject to availability. If weather or other incident or conditions beyond the control of the Sponsor affects the ability for winner and his/her travel companion to redeem any portion of prize during the scheduled date and time, then the Sponsor shall have no further obligation to the winner and/or travel companion other than to supply the remaining elements of the prize package minus the unused portion of prize. Sponsor shall not be responsible for any cancellations, delays, diversions or substitution or any act or omissions whatsoever by the air carriers, hotels, venue operators, transportation companies, prize providers or any other persons providing any prize-related services or accommodations. Sponsor is not liable for expenses incurred as a consequence of flight cancellation/delay. No refund or compensation will be made in the event of the cancellation or delay of any transportation or other prize element except at the sole and absolute discretion of Sponsor. If for any reason whatsoever, winner and/or travel companions are unable to travel after all travel arrangements have been made and paid, the Sponsor shall have no further obligation to the winner. If Grand Prize is forfeited prior to Sponsor finalizing and paying for travel, and there is sufficient time to notify an alternate winner, the prize will be awarded to an alternate winner in a separate random drawing from among all non-winning eligible entries. Winner and travel companions are responsible for obtaining the proper travel documentation (e.g., valid photo ID and/or passport with a minimum validity 6 months after the date of return) prior to travel.  Group Members and Group Leader must be legal U.S. residents. Group Members, or if any Group Member is considered a minor in his/her state of primary residence the Group Member’s parent/legal guardian, and Chaperone, if applicable, must complete and return a Travel Companion Liability & Publicity Release, including acceptance of the Group Leader who will accompany the Grand Prize Winner and Group Members on the Grand Prize trip, if applicable, by the deadline provided. In the event any Group Member and/or Group Leader does not return the Travel Companion Liability & Publicity Release by the deadline provided and there is sufficient time, in Sponsor’s sole discretion, prior to the Grand Prize trip, Sponsor may allow Grand Prize Winner to designate another individual to replace such Group Member and/or Group Leader.

In the event a Grand Prize Winner, his/her Group Member(s) or Group Leader engages in behavior that, as determined by the Sponsor in its sole discretion, is obnoxious or threatening, illegal or that is intended to annoy, abuse, threaten or harass any other person, Sponsor reserves the right to terminate the trip early, in whole or in part, and send the Grand Prize Winner and his/her Group Members and Group Leader home with no further obligation. In the event a winner engages in behavior during travel that (as determined by Sponsor in its sole discretion) is illegal, tortious, or subjects winner to arrest or detention, Sponsor shall have no obligation to pay any damages, fees, fines, judgments or other costs or expenses of any kind whatsoever incurred by winner as a result of such conduct. SPONSOR SHALL HAVE NO LIABILITY FOR ANY PERSONAL INJURIES, DEATH, PROPERTY DAMAGE, OR OTHER DAMAGES OR EXPENSES RESULTING FROM OR ARISING OUT OF ANY TRAVEL RELATED TO THE PRIZE OR ANY OTHER ASPECT OF GRAND PRIZE WINNER’S ACCEPTANCE OR USE OF THE PRIZE.

In the event that CWF does not take place as scheduled, for reasons such as cancellation, preemption or postponement, or for any reason beyond the control of the Sponsor, Sponsor’s sole responsibility will be to award the remaining portion of the Grand Prize and no additional substitution or compensation will be provided.

GENERAL: Participating Entrants and Voters agree to these Official Rules and the decisions of the Administrator and the Sponsor, and release and hold the Sponsor, the Administrator, and their affiliated companies, and all other businesses involved in this Promotion, as well as the employees, officers, directors and agents of each (the “Promotion Entities”), from all claims and liability relating to their participation in the Promotion, and the acceptance and use/misuse of the prize offered. Entrants waive all rights to claim punitive, incidental and consequential damages. Finalists/Winners assume all liability for any injury or damage caused or claimed to be caused, by participation in this Promotion or use/misuse or redemption of a prize. Sponsor is not responsible for any typographical or other error in the printing of the offer, administration of the Promotion or in the announcement of any prize.

No confidential relationship is established by any Contest Entrant or Voter and the Sponsor as a result of participating in the Promotion. None of the information submitted by the Contest Entrant or Voter will be treated as trade secrets, confidential information or as protected data.

Although subsequent attempts to submit a Contest Entry or Vote on a given day may be received, only the first complete Contest Entry/Vote received from a particular Entrant/Voter will be eligible; subsequent attempts by the same person to Enter/Vote, including entries/votes submitted with an alternate email address or identity will be disqualified. In the event of a dispute over the identity of an Entrant or Voter, submission will be deemed submitted by the “Authorized Account Holder” of the email address submitted by the Contest Entrant/Voter. Authorized Account Holder means the natural person to whom the email address is registered. Any Entrant, Voter or potential winner may be required to show proof of being the authorized account holder to Sponsor’s satisfaction. Entry materials/data or Vote materials/data that have been tampered with or altered, or mass entries/votes or entries/votes generated by a script, macro or use of automated devices are void. The Promotion Entities are not responsible for: (i) lost, late, misdirected, damaged or illegible entries/votes; or (ii) error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of submission materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind, or inaccurate transmission of or failure to receive submission information by Sponsor on account of technical problems or traffic congestion on the Internet or at any web site or any combination thereof; or (iii) any injury or damage to Entrant’s, Voter’s or any other person’s computer related to or resulting from participating in the Promotion. By participating in the Promotion, you (i) agree to be bound by these Official Rules, including all eligibility requirements, and (ii) agree to be bound by the decisions of Sponsor and the Administrator, which are final and binding in all matters relating to the Promotion. Failure to comply with these Official Rules may result in disqualification from the Promotion. Sponsor reserves the right to: (i) permanently disqualify from any Promotion it sponsors any person it believes has intentionally violated these Official Rules; and (ii) withdraw any method of entry or voting mechanism if it becomes technically corrupted (including if a computer virus or system malfunction inalterably impairs its ability to conduct the Promotion). If, for any reason, the Promotion is not capable of being conducted as planned, including but not limited to infection by computer viruses, bugs, tampering, unauthorized intervention, fraud, technical failures or other causes whether or not beyond the control of Sponsor, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Promotion. Sponsor is not responsible if the Promotion cannot be implemented or prizes cannot be awarded due to delays or interruptions due to acts of God, acts of war, strikes, governmental action, natural disasters, weather or acts of terrorism. Sponsor also reserves the right in their sole discretion to disqualify any individual found to be violating these Official Rules or suspected of attempting to disrupt or defraud the Entry or Vote process or the operation of the Promotion. Sponsor reserves the right to disqualify any Entrant or Voter at any time during the Promotion Period that may be found ineligible.

In the event any participant engages or has engaged in behavior that (as determined by Sponsor in Sponsor’s sole discretion) is obnoxious or threatening, illegal or that tends to annoy, abuse, threaten, disparage or harass any other person or company including the Sponsor or is otherwise inappropriate, the Sponsor reserves the right to disqualify the Entrant, Voter or winner and void any Contest Entries, Votes or Sweepstakes Entries of said person.

LEGAL WARNING: ANY ATTEMPT BY AN INDIVIDUAL, WHETHER OR NOT AN ENTRANT, TO DELIBERATELY DAMAGE, DESTROY, TAMPER OR VANDALIZE THIS WEB SITE OR INTERFERE WITH THE OPERATION OF THE SWEEPSTAKES, IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND DILIGENTLY PURSUE ALL REMEDIES AGAINST ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.

DISPUTES: Except where prohibited, entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Promotion or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the state of Maryland. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant’s rights and obligations, or the rights and obligations of the Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the state of Maryland without giving effect to any choice of law or conflict of law rules (whether of the State of Maryland or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the state of Maryland. The remedy for any claim shall be limited to actual damages, and in no event shall any party be entitled to recover punitive, exemplary, consequential, or incidental damages, including attorney’s fees or other such related costs of bringing a claim, or to rescind this agreement or seek injunctive or any other equitable relief.

THE PARTIES HEREBY WAIVE THEIR RIGHT TO JURY TRIAL WITH RESPECT TO ALL CLAIMS AND ISSUES ARISING OUT OF OR RELATING TO THIS AGREEMENT WHETHER SOUNDING IN CONTRACT OR TORT, AND INCLUDING ANY CLAIM FOR FRAUDULENT INDUCEMENT THEREOF.
