ONLINE GIVEAWAY 2023 OFFICIAL RULES

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT WILL NOT INCREASE YOUR CHANCES OF WINNING. The National 4-H Council Online Giveaway – 2023 (the “Giveaway”) will commence at 12:00:00 A.M. Eastern Standard Time on August 19, 2023, and end at 11:59:59 P.M. Eastern Standard Time on August 26, 2023 (the “Giveaway Period”). The Sponsor of this promotion is National 4-H Council, 655 15th St NW, Suite 220, Washington, D.C. 20005. (“Sponsor”). Participation constitutes entrant’s full and unconditional agreement to these Official Rules, which are final and binding in all matters related to the Giveaway.

THIS GIVEAWAY IS IN NO WAY SPONSORED, ENDORSED OR ADMINISTERED BY, OR ASSOCIATED WITH ANY SOCIAL MEDIA PLATFORM INCLUDING WITHOUT LIMITATION INSTAGRAM FROM META (“SOCIAL MEDIA PLATFORM”).

ELIGIBILITY: The Giveaway is open only to legal U.S. residents of the US 50/DC who are fifteen (15) years of age or older as of the date of entry. Employees, officers, and directors of Sponsor or Sponsor’s, parents, affiliates, subsidiaries, representatives, legal counsel, advertising, public relations, promotional, fulfillment, and marketing agencies, and members of their immediate families (spouses, parents, siblings, and children, regardless of where they live) and those living in the same household (the “Released Entities”) are not eligible to enter or win. Participation constitutes entrant’s full and unconditional agreement to these Official Rules, which are final and binding in all matters related to the Giveaway. The Giveaway is void where prohibited. Sponsor reserves the right to verify the eligibility of winners.

HOW TO ENTER: Entrants may only enter by performing the below described social media actions using the entrant’s social media account (“Social Media Account”) during the Giveaway Period. Each action may only be taken by an entrant one (1) time and taking each action will qualify as one (1) entry, for a maximum of one (1) entry per person into the Giveaway.

Action 2: Like Sponsor’s Instagram post concerning the Giveaway.
Action 3: Comment on Sponsor’s Instagram post concerning the Giveaway.
Taking all three (3) actions = one (1) entry.

The creation and use of a Social Media Account are subject to the Social Media Platform’s application terms and conditions. You will be required to set your Social Media Account to “Public” in order to participate in the Giveaway. You may not enter more times by using multiple e-mail addresses, identities or devices in an attempt to circumvent the rules. If you use fraudulent methods or otherwise attempt to circumvent the rules your submission may be removed from eligibility at the sole discretion of Sponsor.

Your entry will not be deemed valid for the Giveaway unless (a) it meets the requirements set forth above; (b) complies with the rules of the Giveaway and the rules of the Social Media Platform; (c) does not contain obscene, offensive or objectionable imagery or language, or communication message inconsistent with the positive images to which Sponsor wishes to associate; or (d) does not infringe, misappropriate or violate the rights of any third party. Limit one (1) Social Media Account per Social Media Platform. Multiple entrants are not permitted to share the same email address or Social Media Account. Sponsor is not responsible for lost, misdirected, false, corrupted, illegible or late entries. Sponsor shall have the sole discretion to determine the validity of an entry. All potential winners are subject to verification before any prize will be awarded. Automated or bulk entries or entries submitted by third parties will be disqualified. Incomplete, illegible, corrupted or untimely entries are void and will be disqualified.

PRIZE SELECTION: Following the conclusion of the Giveaway Period, on or about August 28, 2023, ten (10) potential winners will be selected by Sponsor via random drawing from all eligible entries received. The potential winners will receive the prizes described below. The odds of winning the prizes depend on the number of eligible entries received during the Giveaway Period.

The potential winner will be notified via direct message on the Social Media Platforms no later than August 30, 2023. The potential winner must respond via direct message through the Social Media Platform within two (2) days of the original direct message or will forfeit the prize. Prior to being confirmed as a Winner, potential winner will be required to sign and return an Affidavit or Declaration of Eligibility and Liability/Publicity Release within ten (10) calendar days of prize notification. Refusal to do so will result in forfeiture of the prize. If a potential winner cannot be contacted within two (2) calendar days of first notification attempt, if any prize or prize notification is returned as undeliverable, if any potential winner fails to return his/her winner documents within the time set forth above or otherwise rejects his/her prize, or in the event of noncompliance with these Giveaway Official Rules, such eligible winner may forfeit such prize and an alternate eligible winner may be selected from all remaining eligible entries, time permitting. Upon prize forfeiture, no compensation will be given. Potential winner must continue to comply with these Official Rules and winning is contingent upon fulfilling all requirements.

PRIZES:
Prize: There are two (2) prizes available in the Giveaway, as described below:

1. Grand Prize: One (1) winner will receive a one (1) year subscription to CLOVER, an education program for kids. Prize Value: $79.99
2. Second Prize: Ten (10) winners will receive a discount code certificate to be used toward merchandise available on Sponsor’s website at Prize Value: $10.00

Total Prize ARV: $179.99

Prizes are not negotiable. Prizes are non-transferable, and no substitutions are allowed except by Sponsor who may award a prize for one of equal or greater value for any reason. If a prize is not claimed within two (2) days of a winner being notified, an alternate potential winner will be drawn from all remaining eligible entries. Winners are solely responsible for all applicable federal, state and local taxes and fees.

By accepting any prize, the winner agrees further grants permission to Sponsor to use winner’s name, voice, likeness, entry submission and statements for publicity purposes without further compensation, consideration or consent, except where prohibited by law.

SPONSOR’S RIGHTS. Participation in Giveaway constitutes entrant’s grant to Sponsor and its partners and designees, the irrevocable and perpetual nonexclusive right to use, publicly display, print, publish, reproduce, distribute, modify, create derivative works from, and provide access to winner’s entry submission, name, likeness, photograph, picture, portrait, voice, opinions, biographical information and/or any statements made by entrant regarding the Giveaway or the prize(s) for advertising and promotional purposes without limitation, in any media, worldwide, without notice or additional compensation or consent, except where prohibited by law.

GENERAL CONDITIONS. By participating in this Giveaway, each entrant represents that there is no legal or contractual restriction barring participation, including, without limitation, any restriction from entrant’s employer or company. Entrants agree to release, indemnify and hold harmless the Released Entities and the Social Media Platform from any and all liability, for loss, harm, damage, injury, cost or expense whatsoever, including without limitation property damage, personal injury and/or death which may occur in connection with participation in Giveaway, or possession, acceptance and/or use or misuse of prize or participation in any Giveaway-related activity and for any claims based on copyright, trademark, publicity rights, defamation or invasion of privacy.
In case of dispute as to the identity of any entrant, entry will be declared made by the authorized account holder of the e-mail address used to submit the entry. “Authorized Account Holder” is defined as the natural person who is assigned an e-mail address by an Internet access provider, online service provider, or other organization (e.g., business, educational, institution, etc.) responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address or is the owner of the Social Media Account used for the entry at issue. Any potential winner may be requested to provide proof that such winner is the authorized account holder of the e-mail address associated with the winning entry or other proof of identity. The Released Entities are not responsible for technical, hardware, software, network or other communications malfunctions, errors or failures of any kind, lost, interrupted or unavailable network connections, Website, Internet, or ISP availability, unauthorized human intervention, traffic congestion, or failed, incomplete, garbled, jumbled or delayed computer transmissions which may limit one’s ability to enter the Giveaway. Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, extend or suspend this Giveaway should (in its sole discretion) virus, bugs, non-authorized human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Giveaway. In such case, winners will be selected from all eligible entrants prior to and/or after (if appropriate) the action taken. Entrants who do not comply with these Official Rules or attempt to interfere with this Giveaway in any way shall be disqualified. Released Entities are not responsible for any typographical, display, input, or other error in any Giveaway materials, or for any errors or problems which may occur in connection with the administration of the Giveaway, the processing of entries, or in the announcement of prizes, including such error that may give an erroneous indication that a prize has been won.
IN NO EVENT WILL THE RELEASED ENTITIES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR ACCESS TO AND USE OF THE WEBSITE AND/OR THE GIVEAWAY, DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM ANY WEBSITES ASSOCIATED WITH THE GIVEAWAY. WITHOUT LIMITING THE FOREGOING, THIS GIVEAWAY AND ALL PRIZES ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT.

DISPUTES: To the extent permitted by applicable law, entrant agrees that (a) all disputes, claims and causes of action arising out of, or connected with, the Giveaway or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court in the District of Columbia; (b) all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Giveaway but in no event attorneys’ fees; and (c) under no circumstances will entrant be permitted to obtain awards for, and entrant waives all rights to, claim punitive, incidental and consequential damages and any other damages, other than out-of-pocket expenses, and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant's rights and obligations, or the rights and obligations of the Sponsor in connection with the Giveaway, shall be governed by, and construed under, the laws of the Maryland, without giving effect to any choice of law or conflict of law rules (whether of Maryland law or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than Maryland law.

PRIVACY: Information collected from entrants is subject to Sponsor’s Privacy Policy which can be found at https://4-h.org/privacy-policy/. By entering this Giveaway, you agree to the use of your personal information as described in the above Privacy Policy.

WINNERS: The Winner’s list will be made available on Sponsor’s Social Media Platform within a reasonable time after the end of the Giveaway Period and will remain available on those account pages until at least September 26, 2023.
